§ 6-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Alcoholic beverage means alcohol, or any beverage containing more than one-half of one percent of alcohol by volume, which is capable of use for beverage purposes, either alone or when diluted.

    Beer means a malt beverage containing one-half of one percent or more of alcohol by volume and not more than four percent of alcohol by weight, and does not include a beverage designated by label or otherwise by a name other than beer.

    Footcandle means the illumination on a small area of vertical surface one foot from an ordinary candle.

    Liquor means any alcoholic beverage containing alcohol in excess of four percent by weight, unless otherwise indicated. Proof that an alcoholic beverage is alcohol, spirits of wine, whiskey, liquor, wine, brandy, gin, rum, ale, malt liquor, tequila, mescal, habanera or barreteago, is prima facie evidence that it is liquor.

    Premises means the grounds as well as all buildings, vehicles and appurtenances pertaining thereto, and also shall include any adjacent premises, if directly or indirectly under the control of the same person.

    Public dance or public ball means any dance or ball to which admission can be had by payment of a fee, or by the purchase, possession or presentation of a ticket or token, or in which a charge is made for caring for clothing, or any other dance to which the public generally may gain admission with the payment of a fee, directly or indirectly, or without payment of a fee, but shall not be taken to mean or include any dance given at any home or any dance given or held by a bona fide club, admission to which is granted to members and their invited guests and from which the general public is excluded.

    Public dancehall means any room, place, space or building where a public dance is held or conducted.

    Public house of amusement means any and all buildings, tents and other structures constructed, fitted and equipped for the purpose of circuses or theaters, commonly called theaters, or by whatever name designated, which are and shall hereafter be used for public performances, the production and exhibition of plays, dramas, operas or other shows of whatever nature to which admission fees are charged.

    Rectifier means any person who rectifies, purifies or refines distilled spirits or wines, other than vermouth, by any process other than as provided for on a distiller's premises, or who mixes such spirits, wines and other liquors for sale under the name of whiskey, brandy, gin, rum, spirits, cordials, bitters or any other name.

    Retail establishment selling or offering for sale any alcoholic beverage means any place or premises selling or offering for sale, or where there is any consumption of, beer, wine or other alcoholic beverage legally dispensable under applicable statutes of the state. Such definition shall include any such establishment open to the general public, as well as any private club or other establishment serving only members or a limited number of patrons. Such definition shall include all areas of any premises covered hereby, whether such areas are used for the actual sale or consumption of any alcoholic beverage, or for any other purpose.

    Wine means the product obtained from the alcoholic fermentation of juice of sound ripe grapes, fruits, berries or honey, and includes wine coolers.
